How the term EXW is used in international trade

1. Introduction of EXW terms

        EXW trade term for ex works...(named place)
 
        exw means that delivery is completed when the Seller places the goods at the disposal of the Buyer at its place or other designated place, and the Seller does not clear the goods for export or load them on any means of transport。EXW is the term for which the seller is least liable。The Buyer must bear all costs and risks of taking delivery of the goods at the Seller's place。
 
        However, if the parties wish the seller to be responsible for the loading of the goods at the time of shipment and to bear all costs and risks associated with the loading of the goods, this must be clearly stated in the contract of Sale。This term should not be used when the buyer is unable to export directly or indirectly, but FCA should be used if the seller agrees to load the goods at the cost and risk。
 
        A Seller's obligations

        A1 Supply the goods in accordance with the contract
 
        The Seller must provide the goods in conformity with the Contract of Sale and the commercial invoice or equivalent electronic message, as well as any other proof of conformity that may be required by the contract。
 
        B1 Payment of price
        
        The buyer must pay the price in accordance with the sales contract。
 
        A2 Permits, other permits and procedures
 
        The Seller must, at the Buyer's request and at his risk and expense, give the Buyer every assistance when customs formalities are required to help the Buyer obtain an export license or other official permission necessary for the export of the goods。
 
        B2 Licenses, other permits and procedures
 
        The buyer must, at his own risk and expense, obtain any export and import licenses or other official permits and, where necessary, complete all customs formalities for the export of the goods。
 
        A3 Contract of Carriage and Insurance
 
        a) No obligation under the contract of carriage。
 
        b) No obligation under the insurance contract。
 
        B3 Transport Contract and insurance contract
 
        a) No obligation under the contract of carriage。
 
        b) No obligation under the insurance contract。
 
        A4 delivery
 
        The seller must deliver the goods not placed on any transport vehicle to the Buyer at the designated place on the date or period agreed in the contract or, if no date or period is agreed, at the usual time for the delivery of such goods。If no specific delivery point is agreed upon within the designated place, or if several delivery points are available, the Seller may select the delivery point that best suits its purpose from among the delivery points。
 
        B4 Take delivery of goods
 
        The Buyer must take delivery of the goods upon delivery by the Seller in accordance with A4 and A7/B7。
 
        A5 Risk transfer
 
        Except as provided in B5, the Seller must bear all risks of loss or damage to the goods until delivery has been made in accordance with A4。
 
        B5 Risk transfer
 
        The Buyer shall bear all risks of loss of or damage to the goods as from the time of delivery in accordance with A4;Due to the Buyer's failure to notify the Seller in accordance with B7,From the agreed delivery date or the expiration date of the delivery period,However, the goods have been duly assigned to the contract,To the extent that they are clearly marked out or otherwise identified as the goods under the contract。
 
        A6 Cost division
 
        Except as provided in B6, the Seller must bear all expenses in connection with the goods until delivery has been made in accordance with A4。
 
        B6 Cost division
 
        The buyer must pay all expenses in connection with the goods from the time of delivery in accordance with A4;And any additional costs incurred when the goods are placed at the disposal of the Buyer and the Buyer does not take possession of the goods or give the Seller notice in accordance with B7,However, the goods have been duly assigned to the contract,To the extent that they are clearly marked out or otherwise identified as the goods under the contract;And when customs formalities are required,All duties, taxes and other charges payable on the export of goods,And the cost of customs clearance。The Buyer must reimburse the Seller for all costs incurred in assisting the Seller in accordance with A2。
 
        A7 Notify the buyer
 
        The seller must give the buyer adequate notice of when and where the goods will be delivered to the buyer for disposal。
 
        B7 Notify the seller
 
        Once the Buyer has the right to determine the specific time and/or place of receipt of the goods within the agreed period, the Buyer must give the Seller adequate notice to this effect。
 
        A8 Delivery certificate
 
        Transport documents or equivalent electronic messages have no obligation。

        The buyer must provide the seller with proper proof of receipt of the goods。
 
        A9 Check, pack and mark
 
        The seller must pay the cost of the inspection (e.g. quality check, measurement, weighing, counting) necessary to deliver the goods to the Buyer for disposal.。
 
        The Seller must, at its own cost, provide the packing required by the Seller prior to the conclusion of the contract in relation to the transport of the goods (e.g. mode of transport, destination) (unless the goods under the contract do not normally require packing in accordance with relevant industry practice)。Packages should be properly marked。
 
        B9 Goods inspection
 
        The buyer must pay the cost of any pre-shipment inspections, including those mandated by the relevant authorities of the exporting country。
 
        A10 Other obligations
 
        The seller must, at the Buyer's request and at his risk and expense, give the Buyer every assistance in obtaining any documents or equivalent electronic messages issued or transmitted by the State of delivery and/or the State of origin that may be required by the Buyer for the export and/or import of goods and, if necessary, for transit from other States。
 
        At the request of the Buyer, the seller must provide the Buyer with the information required for insurance。
 
        B10 Other obligations
 
        The Buyer must pay all costs incurred in obtaining the documents or equivalent electronic messages referred to in A10 and reimburse the Seller for the costs incurred in providing assistance。
